Curfew for Minors

The Supreme Court issued a TRO on the implementation of the curfew hours on Manila, Quezon City, and Navotas because a group representing the youth filed a petition for it citing that it is unconstitutional.

"The Supreme Court on Tuesday, July 27, temporarily stopped the imposition of curfew ordinances on minors in Manila, Navotas City, and Quezon City.

During their regular en banc session on Tuesday, the High Court issued a temporary restraining order (TRO) enjoining the 3 local governments from implementing their ordinances imposing curfew hours for those 18 years below.

This was in response to the petition filed by youth group Samahan ng mga Progresibong Kabataan (Spark) seeking to declare as unconstitutional the curfew ordinances which, it argued, are curtailing a person’s right to liberty and travel.

“The Court, acting on the petition for certiorari and prohibition with application for a temporary restraining order challenging the ‘Curfew Ordinances’ of the three local governments as ultra vires for being contrary to Republic Act 9334 (Juvenile Justice and Welfare Act), issued a temporary restraining order effective immediately and until further orders enjoining the three local government units from implementing and enforcing the ‘Curfew Ordinance’,” the resolution stated.

The High Court directed the respondents – Manila Mayor Joseph Estrada, Navotas City Mayor John Rey Tiangco, and Quezon City Mayor Herbert Bautista – to comment on the petition within 10 days of notice." --Rappler

In my opinion, there is nothing unconstitutional about the curfew hours. I don't know what these guys are smoking but I think they're way over their head for this petition. It goes to show that the youths of today (most of them) are whiners.

Wala namang issue yang curfew na yan. Mga nagpapasikat lang ang mga bwiset na mga kabataan kaya akala nila maganda. Siguro kapag naranasan na nilang mahold-up or masaksak sa daan kapag dis-oras ng gabi ay baka magbago ang mga isip nila. :drink2:

pansin ko lang. nung wala pa kasing curfew pansin ko dito sa may amin or mga nadadaanan kong lugar pag pauwi ako. madalas nag iinuman mga kabataan or naglalandian/nagliligawan sa kalsada. meron din one time may rambulan nung pauwi ako so ok saken ung curfew kasi ano nga ba naman gagawin ng mga kabataan pag gabi diba bkt nila need gumala pa imbis nattlog diba.

Haiz... Kulang talaga sa disilpina ang kabataan ngayon. Feeling cool at pilit na nagpapakaastig sa paraan ng pag inom pag yosi at paglalampungan sa gabi. Well they are at the age of rebellion pero syempre dapat may limitasyon sila sa oras dahil napakadelikado sa gabi at dapat tahimik ang kapaligiran dahil natutulog ang mga tao. Sa SPARK naman okay may point sila pero parang nagpapasikat lang sila sa ginawa nila eh, we need the curfew for the discipline of the youth.

Dapat nga 9pm pa ang curfew nila instead of 10pm. Kids these days want to grow up fast. They want to get the same treatment as an adult. Ikulong na din kaya natin ang mga minors Na gumagawa ng krimen??

"... it argued, are curtailing a person’s right to liberty and travel." Typical. People talk about their rights when what they really want is entitlement. Freedom without consequence or responsibility.

Sa amin matagal ng may curfew, ang problema 'yung enforcement. Minsan masisisi mo rin 'yung mga magulang, bakit nila hinahayaang pakalat-kalat sa disoras ng gabi mga anak nila.

Wala sa ayos ang ipinaglalaban ng samahan ng kabataan na yan. Ano ba ang gagawin nila sa disoras ng gabi? Ang lahat ng masasamang bisyo o gawain ay ginagawa sa gabi, yan ang totoo. Hindi nila magagawa ang gusto nilang gawin kaya ipinipilit na naman ang karapatan daw nila, ang right to liberty and travel. Para din naman sa kanila ang curfew. Para mailayo sila sa masasamang elemento na naglipana sa gabi. Ito namang SC, dapat hindi na pinagpapapansin ang mga ganitong issue. Too much freedom is bad. Ang sobrang pakikipaglaban dahil sa right-right na yan ay masama. lalo na kung wala na sa katwiran at malalagay sa bingit ng kapahamakan. Therefore, too much of everything is poison.
